LBI and Its Monitor Discuss Getting the Most Out of a Monitorship

FCPA settlements often include appointment of a monitor to ensure that the defendant takes appropriate steps to remedy its compliance failures and improve its policies, procedures and controls. At the SCCE’s European Compliance and Ethics Institute, Thomas Topolski, then-president of Louis Berger International (LBI), a company that is currently subject to a monitorship, and the company’s FCPA monitor, Eric R. Feldman, a senior vice president and managing director of Affiliated Monitors, Inc., discussed the monitorship process, the monitor’s assessment methodology and the lessons to be learned from monitorships.
