The DOJ’s FCPA Corporate Enforcement Policy contained a surprise for some companies: a requirement to retain business records to receive full cooperation and remediation credit when settling anti-corruption issues with the DOJ. The language in the policy is expansive and has left companies and their counsel unsure of how to meet this expectation, particularly with regard to disappearing messaging apps.
