Dan Newcomb Discusses the Unusual Second Extension of Biomet’s DPA

In a rare move, the Department of Justice has extended Biomet’s deferred prosecution agreement for the second time in two years. In March 2015, days before the company’s March 2012 deferred prosecution agreement was set to expire, Biomet announced that the DOJ had informed the company that Biomet’s DPA and monitor appointment had been extended for an additional year. On March 25, 2016, the company announced a second extension, disclosing that the DOJ and SEC are continuing to investigate the company’s activities in Brazil and Mexico as well as “issues” relating to the company’s compliance program.
